o Anthem Could Pay $115 Million in Largest-Ever Data Breach Settlement

San Francisco -- In what could be the largest data breach settlement in history, Indiana-based health insurer Anthem has agreed to pay $115 million to resolve a class action lawsuit stemming from a 2015 data breach that saw the theft of personal information from 78.8 million people. Under the settlement, which still must be approved by a court, Anthem would establish a $115 million settlement fund, used to provide victims with at least two years of credit monitoring, as well as cover their out-of-pocket expenses and provide them with cash compensation. In addition, the settlement requires Anthem to guarantee funding for information security, and implement or maintain specific changes to its data security systems. "After two years of intensive litigation and hard work by the parties, we are pleased that consumers who were affected by this data breach will be protected going forward and compensated for past losses," said Eve Cervantez, co-lead counsel representing the plaintiffs. In early 2015, Anthem acknowledged that it had been the target of a cyber attack, in which the personal information of 78.8 million individuals was stolen, including names, dates of birth, social security numbers and health care ID numbers. More than 100 lawsuits were filed against Anthem, and the cases were consolidated in the U.S. District Court for the Northern District of California. Attorneys from Altshuler Berzon, Cohen Milstein, Girard Gibbs and Lieff Cabraser were court-appointed to lead the representation of the plaintiffs.
